Question about Poke'mon Universe and there existence

My Risky Question,

If you've been playing poke'mon MMO's for awhile you will know of Poke'net.  They where C&D ordered awhile back by Nintendo.  My question is,  what makes Poke'mon Universe so certain that they will not get shut down by Nintendo like Poke'net and what makes them think they can survive like Pokemon Cyrus, Pokemon World Online and Pokemon Destiny because the amount of members is growing much and Poke'net was shut down when they had over 1,000 members and this community is way bigger than that.

p.s.  I'm sorry if I upset anyone part of the PU team.  I am just really excited about the release of this MMO and want it be around for a long time.

They got shut down for making money off the Pokemon name, if anyone makes Money off "Pokemon" they will get shut down.

We aren't certain about anything. We know the dangers of releasing a unofficial Pokemon MMORPG. If Nintendo sent us C&D letters, we would have no choice but to make an original game shut down the project. Simple as that.
